Privacy Policy

This Privacy Policy (“Policy”) describes how VoterPrime, a California nonprofit corporation and 501(c)(3) tax-exempt organization (“VoterPrime,” “we,” “us,” or “our”), collects, uses, and discloses information in connection with the Hungry Eagle mobile application (the “App”). VoterPrime owns and operates the App. VoterPrime may engage service providers to process information on its behalf and subject to its instructions; the App is owned by VoterPrime, and this Policy governs it. This Policy does not apply to third-party services that the App links to or that you elect to use, each of which is governed by its own privacy policy. By downloading, accessing, or using the App, you (“you” or “User”) agree to this Policy and to the Terms of Use set forth below. If you do not agree, do not access or use the App. VoterPrime may modify this Policy and its practices as set forth in Section 11.

Summary

The following summarizes certain commitments described in greater detail below. In the event of any conflict, the full text of this Policy controls.

  • VoterPrime does not sell your personal information.

  • VoterPrime does not use your personal information for political targeting or campaigns.

  • VoterPrime does not collect your party registration or ask how you vote.

1. Information We Collect

VoterPrime collects information to operate, secure, and improve the App. Depending on your use of the App, the categories of information collected may include, without limitation, the following:

Account Information. You authenticate through Sign in with Apple. Apple verifies that the account is yours and provides your name and email address only to the extent you elect to share them. If you use Apple’s Hide My Email feature, VoterPrime generally receives only the relay address generated by Apple. VoterPrime does not receive your Apple password.

Stated Interests. When you describe your civic interests or concerns in your own words, VoterPrime may store that text and use it to identify related legislation, candidates, measures, organizations, and civic opportunities.

Location or District Information. To present relevant legislation and representatives, VoterPrime may determine your general voting district, for example from location or address information you provide.

Activity Information. VoterPrime may store the items you follow and the civic actions you take in order to provide, personalize, and operate the App’s features, including any civic profile generated within the App.

Usage and Technical Information. VoterPrime may collect information regarding your use of the App and technical information such as application version, device type, identifiers, and diagnostic and crash data, in order to operate, secure, and improve the App.

2. Device Permissions

The App may request your permission to access certain features of your device. You may decline any such request and may modify your choices at any time through your device settings. If you decline, the associated feature may not function.

  • Location. Used to determine your voting district for the purpose of presenting local legislation and representatives.

  • Face ID. If enabled, your device confirms your identity before unlocking the App. Face data is retained on your device and is not disclosed to VoterPrime.

3. Use and Disclosure of Information

VoterPrime uses the information it collects to operate, secure, and improve the App and for related purposes consistent with this Policy, including without limitation to interpret your stated interests, present relevant legislation and representatives, maintain your activity and civic profile, deliver civic reminders, analyze usage, develop features, and detect, prevent, and address abuse, fraud, security incidents, and misuse.

Notwithstanding any other provision of this Policy, VoterPrime does not sell your personal information, use your personal information for political targeting or campaigns, or collect your party registration. VoterPrime does not disclose your stated interests or activity to other Users. If sponsor content is displayed within the App, VoterPrime does not disclose your personal information to the sponsor and does not target such content based on your identity or personal information.

VoterPrime may disclose information: (a) to service providers acting on its behalf and subject to its instructions; (b) to comply with applicable law, legal process, or governmental or regulatory requests; (c) to enforce the Terms of Use or other agreements; and (d) where VoterPrime believes in good faith that disclosure is reasonably necessary to protect the rights, property, or safety of Users, the public, or VoterPrime. 

If VoterPrime undergoes an organizational change, your information may transfer as part of that change, subject to protections at least as protective as this Policy.

VoterPrime may use, publish, and disclose aggregate or de-identified information, including without limitation the proportion of Users who express interest in a given issue, to inform the public and elected officials and for other lawful purposes. VoterPrime takes reasonable measures so that such information does not identify any individual.

4. Service Providers

VoterPrime engages a limited set of service providers (“subprocessors”) that process information on its behalf, subject to its instructions, solely as necessary to provide the App, and under obligations of confidentiality. Such subprocessors may include, without limitation:

  • Cloud hosting and application infrastructure providers that store App data and operate the servers supporting the App;

  • Apple, for Sign in with Apple, application delivery, push notification delivery, and crash and diagnostic reporting; and

  • A third-party artificial intelligence provider (currently Anthropic) that processes de-identified text as described in Section 4.

VoterPrime may add, change, or replace subprocessors from time to time. In each case, subprocessors act on VoterPrime’s instructions and may use information only to provide services to VoterPrime.

The App also links to third-party websites and data sources that VoterPrime does not control, including official government sources and nonpartisan civic resources. When you follow such a link, you leave the App, and the third party’s own privacy policy governs your use of its service. VoterPrime is not responsible for the content, availability, or practices of such third parties and may add or change the resources to which the App links.

5. Artificial Intelligence Processing

The App uses artificial intelligence to interpret text you provide and to identify related civic information. Prior to transmitting such text to a third-party artificial intelligence provider for this purpose, VoterPrime takes reasonable steps to remove personal identifiers, including your name, email address, and account identifier. No method of de-identification is wholly effective. By using features that interpret text you provide, you acknowledge and agree that de-identified text will be processed by a third-party provider as described herein. 

6. Your Choices and Rights

Depending on your jurisdiction, you may have rights under the California Consumer Privacy Act and other applicable laws, which may include the right to access, correct, delete, or export your personal information and to opt out of its sale or sharing. VoterPrime does not sell or share your personal information as those terms are defined under applicable law. You may exercise applicable rights as described below, subject to legal exceptions and to verification of your identity.

You may delete your data through the App’s Settings screen, and you may submit requests to HungryEaglePrivacy@voterprime.org. VoterPrime will respond within the period required by applicable law. VoterPrime may decline requests to the extent permitted by law and may retain information it is required or permitted to retain. VoterPrime will not deny you service or charge you a fee for exercising a right except as permitted by law.

7. Data Retention

VoterPrime retains information for as long as your account remains active or as necessary to operate the App, after which it deletes or de-identifies the information. VoterPrime may retain aggregate or de-identified information that does not identify you, and may retain certain information for longer periods where required by law or as necessary to resolve disputes and enforce its agreements. You may delete your account at any time through the App.

8. Security

VoterPrime maintains administrative, technical, and organizational safeguards designed to protect information, including encryption in transit and at rest and access controls. No system or method of transmission or storage is wholly secure, and VoterPrime does not warrant or guarantee the absolute security of information.

9. No Warranty Regarding Information

The App draws on third-party and publicly available data sources and presents information for general educational and civic purposes. VoterPrime does not warrant that any information presented in the App is accurate, complete, current, or fit for any particular purpose. You should confirm any information that is material to you with an official source before acting upon it. Your use of, and reliance on, the App and its information is at your own risk, as further described in the Terms of Use.

10. Children

The App is available to users aged thirteen (13) and older.

11. Changes to This Policy

VoterPrime may modify this Policy and its practices from time to time. Where changes are material, VoterPrime will update the effective date and post the revised Policy, and may provide notice within the App or by email. Your continued use of the App after the effective date of any change constitutes acceptance of the revised Policy.

These Terms of Use (“Terms”) constitute a legal agreement between you (“you” or “User”) and VoterPrime, a California nonprofit corporation and 501(c)(3) tax-exempt organization (“VoterPrime”), governing your access to and use of the Hungry Eagle mobile application (the “App”). By accessing or using the App, you agree to these Terms. If you do not agree, do not access or use the App.

1. The Service

The App is a free, nonpartisan civic engagement application that connects the interests you provide to civic information and action and provides links to nonpartisan resources and third-party services. The App is provided at no cost, and VoterPrime may modify, add, or remove features at any time.

2. Informational Purpose; Nonpartisanship

VoterPrime does not endorse any candidate, party, or position. Information regarding candidates, measures, legislation, and organizations is derived from third-party sources and is provided for informational purposes only. Such information may contain errors or may not be current. It does not constitute legal, voting, or professional advice. You should confirm any information that is material to you, including your voter registration and ballot, with the appropriate official election authority before acting.

3. Data and Artificial Intelligence

The App uses artificial intelligence to interpret text you provide and to identify related civic information. Prior to transmitting such text to a third-party provider, VoterPrime takes reasonable steps to remove personal identifiers so that the provider processes de-identified text. VoterPrime’s collection, use, and disclosure of information is described in the Privacy Policy above, which is incorporated into and forms part of these Terms.

4. Account

You authenticate through Sign in with Apple. You are responsible for all activity conducted under your account and shall promptly notify VoterPrime if you believe your account has been compromised. You must be at least thirteen (13) years of age to use the App.

5. Acceptable Use

You shall use the App only for lawful purposes and in accordance with these Terms. You shall not: misuse the App or interfere with its operation; attempt to access the App or its systems by unauthorized means; scrape, harvest, or copy App content at scale; or use the App to harass, defraud, or harm others. Where you transmit a message to an elected official or organization through a linked service, you are solely responsible for the content you transmit.

6. Third-Party Services and Links

The App links to and may rely upon third-party services and data sources that VoterPrime does not control. VoterPrime is not responsible for the content, availability, or practices of such third parties, and your use of them is governed by their respective terms.

7. Intellectual Property

The App, its name, the Hungry Eagle character, and all original content therein are owned by VoterPrime or its licensors and are protected by applicable intellectual property laws. Subject to these Terms, VoterPrime grants you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for its intended purpose. You shall not copy, modify, distribute, or create derivative works from the App without VoterPrime’s prior written consent. Third-party content remains the property of its respective owners.

8. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. VOTERPRIME DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY INFORMATION PROVIDED THROUGH THE APP IS COMPLETE OR CURRENT.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, VOTERPRIME AND ITS OFFICERS, DIRECTORS, VOLUNTEERS, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM YOUR USE OF, OR RELIANCE UPON, THE APP OR ANY INFORMATION PROVIDED THROUGH IT. WHERE LIABILITY CANNOT BE EXCLUDED, IT SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW. BECAUSE THE APP IS PROVIDED AT NO COST, VOTERPRIME’S TOTAL AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

10. Indemnification

You shall indemnify, defend, and hold harmless VoterPrime and its officers, directors, volunteers, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your misuse of the App or your violation of these Terms.

11. Suspension and Termination

You may cease using the App and delete your account at any time. VoterPrime may suspend or terminate your access if you violate these Terms, or may discontinue the App upon notice to you. Upon termination of your access, the license granted to you under Section 7 terminates, and those provisions that by their nature should survive shall survive.

12. Modification of Terms

VoterPrime may modify or discontinue the App or these Terms at any time. Where changes to these Terms are material, VoterPrime will provide notice within the App or by email. Your continued use of the App after the effective date of any change constitutes acceptance of the revised Terms.

13. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the App shall be brought exclusively in the state or federal courts located in Marin County, California, and you consent to the personal jurisdiction of such courts.

14. Apple

The App is distributed through the Apple App Store. Apple Inc. is not a party to these Terms and is not responsible for the App. Apple is a third-party beneficiary of these Terms and may enforce them against you. Your use of the App is also subject to the Apple Media Services Terms and Conditions.

15. General

These Terms, together with the Privacy Policy above, constitute the entire agreement between you and VoterPrime with respect to the App and supersede any prior understanding. If any provision is held unenforceable, the remaining provisions shall remain in full force and effect. VoterPrime’s failure to enforce any right or provision shall not constitute a waiver thereof. You may not assign or transfer your rights under these Terms; VoterPrime may assign or transfer its rights to a successor. Notices to you may be provided to the email address associated with your account.
